Terms and Conditions

1. Acceptance of Terms

By accessing or using the PLU Health platform, including our provider directory, network management tools, and related services (collectively, the "Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

These Terms apply to all users of the Service, including healthcare organizations, individual providers, payers, health systems, and patients who search our public directory. Continued use of the Service following any updates constitutes acceptance of the revised Terms.

2. Description of Service

PLU Health provides an intelligent provider directory platform that helps hospitals, health systems, and insurance companies streamline network management, verify credentials, and improve patient access to care. Our Service includes real-time provider data, insurance and network matching tools, and custom directory building capabilities.

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice, including the availability of any feature, database, or content.

3. Account Registration & Eligibility

To access certain features of the Service, you must register for an account and provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

By registering, you represent that you are at least 18 years of age and, if registering on behalf of an organization, that you have the authority to bind that organization to these Terms. Organizations are responsible for the actions of any users granted access under their account.

4. Provider Data & Directory Listings

Organizations and providers submitting data to the platform are responsible for the accuracy and completeness of all credentials, specialties, locations, and availability information provided. PLU Health uses automated verification tools and third-party databases including NPPES and NPI registries, but does not guarantee the absolute accuracy of any listing at all times.

Directory listings are provided for informational purposes and do not constitute a referral, endorsement, or guarantee of the quality of care provided by any listed provider. Patients should independently verify provider information before scheduling care.

5. Acceptable Use

You agree not to use the Service to upload false or misleading provider information, attempt unauthorized access to any part of the platform, scrape or harvest data using automated means, or interfere with the normal operation of the Service.

Any violation of this Acceptable Use policy may result in immediate suspension or termination of your account, and PLU Health reserves the right to pursue any available legal remedies.

6. HIPAA & Data Privacy

PLU Health maintains administrative, technical, and physical safeguards designed to protect the confidentiality, integrity, and availability of protected health information ("PHI") in accordance with the Health Insurance Portability and Accountability Act ("HIPAA") where applicable.

Where required, PLU Health will enter into a Business Associate Agreement ("BAA") with covered entities and business associates. Please refer to our separate Privacy Policy for full details on how we collect, use, and safeguard personal and provider data.

7. Subscription & Payment Terms

Paid subscription plans are billed on a monthly or annual basis as selected at checkout. Fees are non-refundable except as required by law or expressly stated in a separate agreement. Prices are subject to change with 30 days' prior notice to active subscribers.

Failure to pay applicable fees may result in suspension or termination of access to paid features. Enterprise pricing and custom terms may be governed by a separate signed agreement, which shall take precedence over these Terms in case of conflict.

8. Intellectual Property

All content, trademarks, software, and technology comprising the Service, excluding user-submitted provider data, are the exclusive property of PLU Health, Inc. or its licensors and are protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Service solely for its intended purpose. You may not copy, modify, distribute, or reverse-engineer any part of the Service without prior written consent.

9. Limitation of Liability

To the fullest extent permitted by law, PLU Health shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, including but not limited to reliance on directory data or provider availability information.

In no event shall PLU Health's total aggregate liability exceed the amount paid by you to PLU Health in the twelve (12) months preceding the event giving rise to the claim.

10. Termination

PLU Health may suspend or terminate your access to the Service at any time, with or without cause, including for violation of these Terms. You may cancel your account at any time through your account settings or by contacting our support team.

Upon termination, your right to use the Service will immediately cease. Provisions relating to intellectual property, limitation of liability, and governing law shall survive termination of these Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Cook County, Illinois.

12. Changes to Terms

We may update these Terms from time to time to reflect changes in our practices, legal requirements, or the Service itself. Material changes will be communicated via email or a prominent notice on the platform at least 15 days before taking effect.

Your continued use of the Service after any such changes take effect constitutes your acceptance of the revised Terms.
